Terms and Conditions for the Purchase of Tony Langley's Football Hedging System and use of the website

Background

This agreement applies between you the User of the Web Site, and Waverley Media Ltd (and its subsidiary Markiteer Ltd), together the owners of this Web Site. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these Terms and Conditions, you should not purchase Tony Langley's Football Hedging System, and you should stop using the Web Site immediately.

Tony Langley's Football Hedging System is a joint venture partnership between Waverley Media Ltd, its subsidiary Markiteer Ltd, and Tony Langley.

Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

The term 'you' refers to the user or viewer of our website.

• "Content"

Means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;

• "The Company"

Means Waverley Media Ltd and its subsidiary Markiteer Ltd, of Waverley Farm, Waverley Lane, Farnham, GU8 9EP

• "The Programme"

Means your purchase of and any subscriptions to Tony Langley's Football Hedging System, the methods taught by Tony Langley as part of the System, which are provided via the website http://helpdesk.football-hedging-system.com, and all support and services provided via http://helpdesk.football-hedging-system.com, personal email, and any face-to-face training.

• "Service"

Means collectively any online (paid or otherwise) facilities, tools, services or information that The Company makes available through the Web Site either now or in the future;

• "System"

Means any online communications infrastructure that The Company makes available through the Web Site either now or in the future. This includes, but is not limited to, downloadable PDF or MP3, video, web-based email, message boards, webinars, live chat facilities and email links;

• "User"/"Users"

Means any third party that accesses the Web Site and is not employed by The Company and acting in the course of their employment; and

• "Web Site"

Means the website that you are currently using (http://helpdesk.football-hedging-system.com, www.football-hedging.com, or www.football-hedging.co.uk ) and any sub-domains of these sites unless expressly excluded by their own terms and conditions;

• "Member's Area"

Means areas of the website reserved for those who have made a purchase and which contains downloadable content and any future additional services.

• "Subscription"

Means the contract you have entered into with The Company to pay for Tony Langley's Football Hedging System as follows:

o Gold Option subscribers: You will pay £1297 up-front at point of purchase. After 30 days, you will pay £201 every 30 days, representing £159 per month for support to be delivered via the website http://helpdesk.football-hedging-system.com and personal email, and a further £42 every 30 days for Tony’s email recommendations. You may cancel both of the ongoing subscription payments, or just the payment for the email recommendations, after 145 days, but not before.

o Platinum Option subscribers: You will pay £1597 up-front at point of purchase. After 30 days, you will pay £121 every 30 days, representing £79 per month for support to be delivered via the website http://helpdesk.football-hedging-system.com and personal email, and a further £42 every 30 days for Tony’s email recommendations. You may cancel both of the ongoing subscription payments, or just the payment for the email recommendations, after 145 days, but not before.

o Diamond Option subscribers: You will pay £2597 up-front at point of purchase. This is a one-time all-inclusive payment which includes ongoing support via the website http://helpdesk.football-hedging-system.com and personal email, all future upgrades and enhancements, an additional sixth trading method, and a full day ‘live’ face-to-face training workshop (limited to offered dates).

All amounts shown above are inclusive of VAT and taxes where applicable.

If you wish, you may cancel any ongoing subscription payments after 145 days. You may also cancel ongoing subscription payments for Tony's email
recommendations but continue with your support payments.

You may not cancel support payments but continue to make payments to receive Tony's email recommendations.

Your subscription is valid for a single user only. You must not share your login details with anyone else.

You may use your login details to access the Programme from one geographical location at a time.

Any user found to be sharing their subscription with one or more third parties, or found to be logged in to the Website from multiple locations at the same time will have their subscription suspended and their user account locked. No refunds will be available to users found to have violated these terms under any circumstances including the 145 Day Money-Back Guarantee.

If you believe that a third party has gained access to your login details without your permission you should contact Waverley Media immediately in order that your password may be reset.

Your Payment for Tony Langley's Football Hedging System

Your up-front payment and any ongoing payments due for Gold and Platinum Package subscribers will be processed from the debit or credit card details which you gave us when you purchased. The ongoing subscription payments made by Gold and Platinum Package subscribers are processed automatically every 30 days. For clarity, this means that if you made your initial purchase on the 1st day of a 31-day calendar month, your 2^nd payment will be processed on the 31st of the month.

145 Day Money-Back Guarantee

Tony Langley's Football Hedging System has been sold to you with a 145-day Money-Back Guarantee.

Specifically, this means that you may try out and test the programme for 145 days starting on the day your purchase the system. During this period, you must trade at least 30% of the selections sent by Tony Langley. For the avoidance of doubt it does not matter when you begin to trade yourself but you must have traded 30% of the total trades sent to you during the 145 day period in order to qualify for a refund.

You must begin with a trading bank of at least £300 and must maintain a minimum of this amount throughout your trading.
If, after a period of 145 days, your bank has not grown by at least 30% per month (pro rata for the number of trades you have taken compared with the number of trade recommendations Tony has given), and so long as you have traded according to the systems Tony has taught you and have traded at least 30% of the recommendations, then you may apply for a refund by submitting your completed log.

You must use only the log provided to you and not one you have devised yourself. Your log must be clearly and correctly filled in and fully  demonstrate that you have taken at least 30% of the trades provided by Tony Langley. Whilst you may also trade matches not recommended by Tony, these will only be taken into account when determining your eligibility for a refund if they adhere completely to Tony’s criteria and rules. Any trades where you have failed to trade according to Tony's criteria and rules will be discounted.

You must also be up-to-date with all required support and other payments within the 145 day period.

Providing you are able to demonstrate that you have correctly traded at least 30% of the selections provided by Tony, but that your trading bank has not grown by at least 30% per month (pro-rata for the number of trades you have taken), and so long as you are up-to-date with all support payments due, and have maintained a minimum trading bank of £300 throughout then you will receive a refund for all payments you have made for the programme, both the up-front payment and any ongoing support payments.

Refunds will be processed within 14 days.

Please note you may not apply for a refund under the 145 Day Money-Back Guarantee until 145 days after you made your initial purchase of the Programme.

If you have withdrawn money from your bank within the 145-day period and have not allowed your profits to compound, a calculation will be applied to your results to see whether your bank would have grown by at least 30% per month if you had not withdrawn any money. If you have withdrawn money from your account and not made at least 30% profit per month, but would have done had you not withdrawn any money, then you will not be eligible for a refund.

The Company will not be responsible for anything whatsoever that limits your ability to trade, including but not limited to illness or other personal problem you may encounter, issues with your own broadband speed or computing capability, or availability of third party websites such as Betfair or other betting exchanges.

 

Your Right to Cancel your Order

Under the Consumer Contracts Regulations, you have 14 days from the date of purchase in which to cancel your purchase of the Programme and receive a refund, providing you have not accessed the members area by logging in to http://helpdesk.football-hedging-system.com or, in the case of Diamond purchasers, attended the Training Day. For the avoidance of doubt, Diamond Purchasers who within 14 days from date of purchase have either: a) attended a Training Day, or b) have logged in to into the members area, will not be entitled to cancel their purchase and receive a refund. Refunds will be processed within 14 days of your cancellation.

You may cancel by sending an email to us at: support@football-hedging-system.com or by printing off the cancellation form and posting or faxing it to us.

Once you have accessed the members area you may no longer claim a refund under the Consumer Contracts Regulations.

Otherwise, refunds are only available under the terms of the 145-day Money-Back Guarantee.

No other refunds are available for any reason whatsoever.

Your Right to Cancel ongoing Subscription Payments

You may cancel your subscription for support and/or for receiving Tony's recommendations at any point after 145 days of making your initial purchase by sending an email to as at support@football-hedging-system.com, or by using the attached Cancellation Form. To enable us to correctly identify your account, your email should contain the name under which you purchased the Programme, your Member's Area User Name, and your postcode.

Cancellation emails must be received during normal business hours, which are Monday-Friday, 9am to 5pm excluding UK Bank Holidays.

Due to the 30-day payment cycle, you may find that your next subscription payment is due to be processed on a Saturday, Sunday, or Bank Holiday. If you wish to cancel your subscription before this payment is processed, and in order to ensure that the payment is not processed, you must ensure that your email is sent before 5pm on the preceding working day, otherwise that payment will be taken automatically and will not be eligible to be refunded.

Cancellations received outside normal business hours will not be processed until the following working day. For clarity, if a subscription payment has been processed in the meantime, it will not be eligible for a refund.

Computer Capability and Broadband Speed

A slow computer or broadband connection may affect your ability to trade using Betfair or other betting exchanges. You must use a PC, laptop, or Mac that allows you to look at websites and have access to a broadband connection with adequate speed. The Company is not responsible for any limitations to your trading due to your own computer or broadband speed. Betfair and other betting exchanges should be contacted directly with any queries related to required computing power or broadband speeds.

Intellectual Property

Unless specified by The Company, all Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of The Company, or our affiliates. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws.

Unless given permission by The Company you may not print, reproduce, copy, distribute, store or in any other fashion re-use Content from the Web Site in any other capacity other than for personal use unless otherwise indicated on the Web Site or unless given express written permission to do so by The Company. Specifically you agree that: you will not use the Content of the Web Site for commercial purposes; you will not use distribute the content of the Web Site in any form whether verbal, electronic printed or other form to any third party; and you will not systematically copy Content from the Web Site with a view to creating or compiling any form of comprehensive collection, compilation, directory or database unless given express written permission to do so by a representative of The Company.

Third Party Intellectual Property

Where expressly indicated, certain Content and the Intellectual Property Rights subsisting therein belongs to other parties. This Content, unless expressly stated to be so, is not covered by any permission granted by these Terms and Conditions to use Content from the Web Site. Any such Content will be accompanied wherever possible by a notice providing the contact details of The Company and any separate use policy that may be relevant.

You may under no circumstances redistribute in any form whatsoever video, PDF or MP3 or any other content to any third party.

Fair Use of Intellectual Property

Material from the Web Site (except information, Videos, PDF or MP3 files or any other material supplied as part of your subscription) may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

You acknowledge that The Company reserves the right to monitor any and all communications made to us or using our System, which then may be subject to moderator approval and potentially removed without notice.

In order to use the Forums/Chat and any other communication facility that may be added in the future or to submit Content, you are required to submit certain personal details. By continuing to use the Web Site you represent and warrant that:

• any information you submit is accurate and truthful; and
• you will keep this information accurate and up-to-date.

By submitting Content you warrant and represent that you are the author of such Content or that you have acquired all of the appropriate rights and / or permissions to use the Content in this fashion. Any Users banned in this way must not attempt to use the Website under any other name or by using the access credentials of another User, with or without the permission of that User. Any instance of termination or suspension will also apply to any downloadable content provided in the Members Area.

Third Party Products and Services

In the circumstances where you may be able to order services, merchandise or other products through our Website from other parties (collectively, the "Third Party Sellers"). All matters concerning the services, merchandise and other products desired from the Third Party Sellers, including, but not limited to, purchase terms, payment terms, warranties, guarantees, maintenance and delivery, are solely between you and the Third Party Sellers. Tony will make every effort to ensure that customers are made aware whenever he will be unavailable for more than a day. Specifically, Tony will be unavailable to support members during the period from 30th April 2017 to 18th May 2017.

Your Password and User Account

If you are a Member or Subscriber of this Website, you are entirely responsible for maintaining the confidentiality of your password and user account information. You must notify us immediately in the event of any known or suspected unauthorised use of your user account, or any known or suspected breach of security, including loss, theft, or unauthorised disclosure of your or anyone else's password. Whilst every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.

No Waiver

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

Notices

All notices / communications shall initially be given to either party by email. The Company’s address for all notices is support@football-hedging-system.com. Such notice will be deemed received on the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday. Subsequent communication from The Company to you will indicate whether notification by post to our premises is also required.

Law and Jurisdiction

These terms and conditions and the relationship between you and The Company shall be governed by and construed in accordance with the Laws of England and Wales and The Company and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
